On November 29, 1999, President Clinton signed into law the Superfund Recycling Equity Act (Pub. Law 106-113). This law clarifies Superfund to state that recycling is not disposal and shipping for recycling is not arranging for disposal.

Compliance with the new law imposes some additional requirements on those who sell scrap for recycling. This includes ensuring that the companies who receive scrap from The David J. Joseph Company are in compliance with substantive provisions of environmental laws. [See 42 U.S.C.A. 127(c)(5)] The Company has performed a survey of its customers as part of its own compliance initiative.
